TERMS OF Conditions

1. Agreement to Terms
 These Terms of Conditions (“Terms”) constitute a legally binding agreement between you (“you,” “your,” “user”) and Aris Lunara MedSpa and Aesthetics, PLLC (“we,” “us,” “our”) regarding your access to and use of our website ArisLunaraAesthetics.com (the “Site”) and any related services (collectively, “Services”). By accessing or using the Site or Services, you agree to these Terms. If you do not agree to all the Terms, you may not use the Site or Services.

2. Modification of Terms
 We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will endeavor to notify you of any material changes (for example by posting notice on the Site or via email). Your continued access or use of the Site following such changes constitutes acceptance of the new Terms.

3. Eligibility
 You represent and warrant that you are of legal age (18 or older) and have the legal capacity to enter into this agreement. If you are using the Site on behalf of a minor or in connection with treatment of a minor, you warrant that you are the parent or legal guardian and you consent to and accept these Terms on behalf of the minor.

4. Services; Booking; Payment
 a. The Site may allow you to book appointments, purchase products, or request services offered by us. All bookings or purchases are subject to availability and our confirmation.
b. Payment terms (when applicable) will be as specified at the time of booking or purchase. You must provide accurate and complete payment information and you authorize us to charge your payment method for the total amount of the services or products plus any applicable taxes, fees, or other charges.
c. Cancellation and rescheduling policies:

Appointment Cancellation, Rescheduling & No-Show Policy

At Aris Lunara MedSpa and Aesthetics, PLLC, we reserve appointment times exclusively for each client to ensure the highest level of care and service. Because our providers’ time is valuable and limited, we kindly ask that you review and respect the following policy.

Cancellation Policy

  • Appointments must be canceled at least 24 hours in advance of the scheduled appointment time.

  • Cancellations made less than 24 hours before the appointment will result in a $50 cancellation fee or forfeit of the deposit, whichever is greater.

  • Same-day cancellations are treated as late cancellations.

Rescheduling Policy

  • Appointments may be rescheduled once without penalty if done at least 24 hours in advance.

  • Rescheduling requests made within 24 hours of the appointment time may incur a $25 rescheduling fee.

  • Multiple rescheduling requests may require a non-refundable deposit to secure future bookings.

No-Show Policy

  • A no-show is defined as missing an appointment without notice.

  • No-shows will be charged 100% of the scheduled service fee or will forfeit their deposit.

  • Clients who no-show more than once may be required to prepay in full for all future appointments.

Late Arrival Policy

  • Clients arriving more than 10 minutes late may have their appointment shortened or rescheduled to avoid disrupting other scheduled clients.

  • If an appointment must be rescheduled due to late arrival, it may be treated as a late cancellation.

Deposits & Prepayment

  • Certain treatments, extended services, or high-demand appointments may require a non-refundable deposit at the time of booking.

  • Deposits will be applied toward the service total at checkout.

  • Deposits are forfeited for late cancellations or no-shows.

  • Deposits and prepaid services are non-refundable

  • Missed or late canceled appointments will be deducted from prepaid packages

  • Packages expire according to their stated terms

Emergency Exceptions

We understand emergencies happen. Exceptions may be made at the discretion of management for documented medical or family emergencies.

Agreement to Policy

By booking an appointment with Aris Lunara MedSpa and Aesthetics, PLLC, you acknowledge and agree to this cancellation, rescheduling, and no-show policy.

Booking Disclaimer

A valid credit card is required to book appointments. Cards are securely stored and only charged in accordance with our cancellation and no-show policy. d. We reserve the right to refuse or cancel bookings or services for any reason (e.g., suspected fraud or safety concerns).

5. Your Obligations
 You agree to:

  • Provide accurate, current, and complete information when booking or using the Site.

  • Comply with all applicable laws, regulations, and licensing requirements in the context of the services you receive.

  • Use the Site and Services only for lawful purposes and not in a way that violates or infringes the rights of others or restricts or inhibits anyone else’s use of the Site.

6. Intellectual Property
 All content, features, and functionality of the Site (including but not limited to text, graphics, logos, images, video, software) are owned by us or our licensors and are protected by U.S. and international copyright, trademark, patent, trade secret or other proprietary rights. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any material from the Site without our prior written consent.

7. Disclaimers; No Medical Advice
 a. The content on the Site is provided for general informational purposes only and does not constitute medical or aesthetic treatment advice, diagnosis or recommendation. You should consult a qualified professional for any such services.
b. The services provided by us (whether booked via the Site or otherwise) are subject to your consultation with us and our professional judgment; results may vary. We make no guarantees regarding outcomes.
c. Except as expressly stated in these Terms, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose or non-infringement.

8. Limitation of Liability
 To the maximum extent permitted by law, neither we nor our owners, directors, employees, agents or affiliates will be liable for indirect, special, incidental, punitive, or consequential damages (including lost profits, loss of data, personal injury, or business interruption) arising out of or in connection with your access or use of the Site or Services, even if advised of the possibility of such damages.
Our total aggregate liability for claims arising out of or relating to these Terms or your use of the Site or Services will not exceed the amount you paid us in the last 12 months (or if no payment was made, then USD $500.)

9. Indemnification
 You agree to defend, indemnify and hold harmless Aris Lunara MedSpa and Aesthetics, PLLC, its affiliates and their respective officers, directors, employees, agents and representatives from and against any and all claims, liabilities, damages, losses or expenses (including reasonable attorneys’ fees and costs) arising out of or in any way connected with your violation of these Terms or your misuse of the Site or Services.

10. Governing Law; Dispute Resolution
 These Terms and any dispute arising out of or relating to them will be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of laws principles. You agree that any legal action or proceeding arising under or relating to these Terms will be brought exclusively in the state or federal courts located in Canadian County, Oklahoma, and you consent to the personal jurisdiction and venue of such courts.

11. Termination
 We may suspend or terminate your access to the Site or Services at any time, for any or no reason, without prior notice. Upon termination, your right to use the Site or Services immediately ceases. All provisions of these Terms which by their nature should survive termination shall survive (e.g., ownership, disclaimers, indemnification, limitation of liability, governing law).

12. Severability
 If any provision of these Terms is held to be invalid, illegal or unenforceable in any respect under applicable law, such provision shall be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of these Terms shall continue in full force and effect.

13. Entire Agreement
 These Terms constitute the entire agreement between you and us regarding your use of the Site and Services, and supersede and replace any prior agreements between you and us relating to the subject matter herein.

14. SMS Terms and Conditions

  1. SMS Consent Communication:

    • The information (Phone Numbers) obtained as part of the SMS consent process will not be shared with third parties for marketing purposes.

  2. Types of SMS Communications:

    • If you have consented to receive SMS text messages from Aris Lunara MedSpa & Aesthetics, PLLC, you may receive messages related to the following

      • Appointment Reminders

      • Appointment Confirmation

      • Scheduling Changes

      • Follow-up messages

      • Billing inquiries

      • Promotions

      • Marketing

  3. Message Frequency

    • Message frequency may vary. You may receive up to 6 SMS messages per week regarding your appointment confirmation, appointment reminders, scheduling changes, follow-up messages, billing inquiries, promotions, and marketing.

  4. Potential Fees for SMS Messaging:

    • Please note that standard message and data rates may apply, depending on your carrier’s pricing plan. These fees may vary if the message is sent domestically or internationally. 

  5. Opt-In Method:

    • You may opt-in to receive SMS messages from Aris Lunara MedSpa and Aesthetics, PLLC in the following ways:

      • Verbally, during a conversation

      • By submitting an online form

      • By filling out a paper form

  6. Opt-Out Method:

    • You can opt out of receiving SMS messages at any time. To do so, simply reply “STOP” to any SMS message you receive. Alternatively, you can contact us directly to request removal from our messaging list. 

  7. Help:

    • If you are experiencing any issues, you can reply with the keyword “HELP”. Or, you can get help directly from us at arislunaraaesthetics.com, or contact us at (405 563-1255). 

    • Additional Options: 

      • If you do not wish to receive SMS messages, you can choose to not check the SMS consent box on our forms.
